Notice on Hong Kong Standard Patent Application

Hong Kong's standardized patents implement a system of registering designated national patents. During the transition period, the designated patent offices include the Chinese Patent Office, the UK Patent Office, and the European Patent Office. Chinese invention patent applications are eligible for Hong Kong standard patent rights.



1、 The registration process and required documents for applying for a standard patent



• Phase 1: Application Record


The first registration is a request to register a designated patent application. Applicants for patent applications in China, the United Kingdom, or Europe (designated as the United Kingdom) should submit a registration request (i.e. application for a standard patent) to the Hong Kong Intellectual Property Department at any time within 6 months from the date of publication. The registration request should include the following documents:

A) A copy of the published designated patent specification (you need to confirm that the specification copy is a true copy of the document issued or kept by the designated patent authority);

B) Record Request Form (Applicant Information: Name, Address, Telephone, Fax, etc. (in both Chinese and English))

C) If the applicant is inconsistent with the public text, a proof document of the transfer of application rights must be provided;

D) The Chinese and English names of the invention.



(2) Phase 2: Request registration and authorization



The second registration is a request to register the designated patent application and grant a standard patent for the invention described in the designated patent specification. Registration and authorization requests shall be made within 6 months after the designated patent application is granted patent rights by the designated patent office, or within 6 months from the date of publication of the request for record of the designated patent in Hong Kong (whichever is later). Registration and authorization requests should include the following documents:

A) One copy of the patent specification (including specification, claims, and drawings) verified by the designated patent office;

B) Registration request letter;

C) If the person making the registration and authorization request is not the standard patent applicant registered in the register, the requester shall provide it in a legal manner

Declaration of obtaining the right to apply and supporting documents;

D) If priority has been claimed in the registration and authorization requests, a copy of the priority document should be provided;

In the above-mentioned documents, the names or titles of the inventors and applicants should be annotated with Roman letters for phonetic translation. The names and abstracts of the inventions should be provided in both Chinese and English, while other documents should be provided in Chinese or English. If the original document is not in both Chinese and English, a translation should be provided.

After passing the formal examination, the Patent Registry of the Hong Kong Intellectual Property Department will approve the registration and grant Hong Kong standard patents. The authorization notice will be published in the Hong Kong government announcement, and the patent certificate will be submitted to the patentee.

    

2、 Validity period and annual fee

1. 20 years from the application date of the original designated patent, but the effective date must start from the date of publication of the authorization notice in the Hong Kong Government Gazette. Once approved, Hong Kong standard patents have independence and are not affected by changes in the legal status of the original designated patent.

2. The renewal fee shall be paid within 3 months before the expiration of the third year from the date of approval, and shall be paid annually before the expiration thereafter.
